Monmouth County Estate Planning Lawyer Christine Matus Explains the Meaning of Intestate in New Jersey

The lawyer mentions that many people would think that once they pass away, their estate will be passed on to the family members that they want to give it. This may be true to some degree, however, without a will, there is no guarantee that the family estate will be given to the remaining family members.
“The term intestate simply means dying without a will. In New Jersey, if you die without a valid will in place, your estate is subject to what is called intestate succession, or the way the state has decided your estate will be distributed,” says the Monmouth County estate planning lawyer.
In New Jersey, the intestate law will determine who can inherit the estate if there is no will. The law will decide the best and most amenable way to divide the assets and property among the heirs.
The article discusses the fact that, according to New Jersey's intestate law, if someone dies with no spouse, their children will inherit all. If the spouse has all the assets, even if there are no children or living parents, the spouse will. The same applies if there is a surviving spouse but no children or spouse, then the parents inherit all.
The estate planning lawyer also mentions that the intestate can provide for grandchildren, stepchildren, and grandparents in addition to the above. The state will inherit the estate if there are no surviving relatives.
The lawyer also says that an intestate succession might sound like a sensible option. But it is possible for things to go wrong. She gave the example of someone who has raised stepchildren as their children. The step-parent may not be able or able to provide for them after their death.
According to attorney Matus, “Even if your wishes basically reflect that of the state’s intestate succession, having it clearly and concisely defined in a will can avoid the expense and delay caused by having to locate heirs or having your estate subject to possible litigation.”
Lastly, attorney Matus emphasizes that it’s very important to prepare a will as it is one of the most foundational ways to ensure that someone’s wishes will be carried out after they die.
