Ontario Divorce Law Myths Debunked In Toronto Family Lawyer’s New Guide

A new guide published by Ivan Steele Law addresses the most common misconceptions about Ontario family and divorce law.

Ivan Steele knows that, as with all legal matters, divorce proceedings are often complicated by misconceptions, erroneous assumptions, and, in separation cases in particular, antiquated beliefs.
As such, Ivan starts by addressing what he believes is the most common misconception, and one that he personally had to debunk for a number of clients; contrary to popular belief, the children do not always go with the mother. The court does not make decisions based on dated gender norms, the guide explains; rather the court only considers the best interests of the child and looks at each parent’s ability to care for the children. “The idea that children default to the mother is nothing more than soap opera lore,” Ivan adds.
Another common myth that Ivan observed in his years of experience representing clients in divorce cases, is that everything will be split 50/50. He explains that, while Ontario does lean toward equal division of “family property”, there are exceptions, such as inheritance and gifts, and in some cases the matrimonial home.
In the guide, Ivan also addresses the belief that spousal support lasts forever, saying: “Spousal support doesn’t necessarily last until retirement, or death. Many factors, like the length of the marriage, age, and each party’s income, play a role in determining if you are eligible or how much and for how long you may be able to receive support from your spouse.”
While all the myths listed in the article are important to address, Ivan believes that one, in particular, takes precedence - the idea that one does not need a divorce attorney. He stresses that divorce is not DIY territory and that, by working with a divorce lawyer, individuals can avoid falling for these other common myths.
